Intergovernmental Agreement Between the County of El Dorado and Shingle Springs Band of Miwok Indians

The Agreement between the County of El Dorado and Shingle Springs Band of Miwok Indians provides an abundance of benefits for the residents of El Dorado County. The tribe wants the public to understand the specifics of this agreement and the benefits it will have for El Dorado County.

The tribe has committed funding to build new HOV lanes on Highway 50.

HOV Funding
 Tribe will provide $5.2 million per year funding for 20 years to construct HOV lanes.
 This project is an existing one that Caltrans has already planned and reviewed under CEQA and approved for construction once funding is available.

We must maintain a safe and secure community in El Dorado County. The tribe will help to increase public safety funding to benefit everyone in the region.

Public Safety/Law Enforcement
 $500,000 annually (made in quarterly payments), with $250,000 paid six months in advance of the casino opening.

Furthermore, the tribe has agreed to make payments to the county in lieu of sales and hotel taxes.

County Revenue Tax
 The Tribe has agreed to collect sales and transient hotel taxes equal to those required of commercial businesses in the county so as not to have a competitive advantage and to share $500,000 of those collections, annually with the County.

General Discretionary Funds
 A fixed amount of $2 million annually for years one through seven.
 A fixed amount of $1.3 million annually for years eight through 20, plus an additional payment of $2.5 million for years eight to 20 (or life of compact), subject to a 2% escalator each year.
 An additional $100,000 per annum for each 100 Class III slot machine over the base 2,000 slots.

Compliance
 Tribe will comply with identified county building ordinances.

Hiring Preference
 Casino will have a preference for Native Americans and local county residents.

In this agreement, the county has also agreed to support the tribe’s interchange and casino projects in its efforts for self-reliance.

County Support of Projects

 County will cease to oppose the project, including asking for the dismissal of all lawsuits, state and federal, concerning the tribe’s projects.
 County will support the tribe’s interchange project, including its continued inclusion into the Metropolitan Transportation Improvement Plan (MTIP).
 County will support any efforts by the tribe to renegotiate its Tribal-State Compact with the State of California.

Renegotiation
 After seven years, either the tribe or the county may request a renegotiation of the agreement.

Dispute Resolution
 County and tribe will meet at least once a year to discuss any concerns with the agreement, communities or any other issues as desired.
 Tribe and county agree to meet and confer on any disputes with the agreement within 10 days.
 The tribe waives its sovereign immunity to a judicial review in federal court and most state courts for any disputes. Arbitration is an option and can be agreed upon by both parties.

 If the tribe increases the number of slot machines, an additional $100,000 a year for each additional 100 Class III slot machines will be paid to the county over the course of the agreement.
